Eligibility & Entry Guidelines
Entrants may be of any age to enter, however those entrants under 18 years of age require a parent’s consent. A checkbox has been provided to allow parental consent to enter the contest. Employees of FMS Models and RC Driver (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
Agreement to Rules
The FMS Models Giveaway is open internationally. Only one entry per person will be accepted; all subsequent entries will be disqualified. Any failure to adhere to these Giveaway Rules may result in disqualification from the contest. No purchase is necessary. VOID WHERE PROHIBITED OR RESTRICTED BY LAW By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of RC Driver as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state and local laws.
International Terms- This giveaway is available internationally. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. You are soley responsible for knowing the laws of your country in reguards to entering giveaways and what must be legally done to enter. You will be responsible for exact shipping costs, shipping insurance, any taxes, fees, tarrifs, paperwork or other legal responsibilities after the giveaway items have shipped from RCDriver, this includes package loss. We will not reimburse for any costs associated with this giveaway or potential loss.
Sweepstakes Period
Entries will be accepted online only. You must follow the process described in the Giveaway announcement video in order to be elligable. Winners will be chosen shortly after the July 5, 2022 Giveaway Closing. Note, once the date t is reached, a notice that the Giveaway is closed will be posted in the announment video description.
Prize Selection and Notification
A Prize Winner will be selected in a random drawing conducted via CommentPicker.com from all eligible entries posted in the Giveaway announcement video, with the winner being contacted shortly thereafter. The total number of eligible entries received will determine odds of winning. Entries become the property of RC Driver and will not be returned.
Winner selection and notification: Winner of the Giveaway will be selected as mentioned above under the supervision of the Sponsor. Winner will be notified via email to the email address they entered the Giveaway with within three (3) days following the winner announcement video on Youtube. FMS Models and RC Driver shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner may be selected. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Missing or Misdirected Entries
RC Driver and FMS Models are not responsible for missing, incomplete or misdirected entries.
Rights Associated with Contest
Submission of the Entry Form constitutes permission for RC Driver to use the participants’ name, likeness, biographical information, information and materials contained in the Entry Form, photographs, and any statements or remarks made about the Giveaway in advertising and promotion without further compensation or permission, except where prohibited by law. All entries, and any copyrights therein, become the sole property of RC Driver. By entering, entrants agree to abide by the above stated rules, and grant to RC Driver the right to edit, publish, promote, and otherwise use their entry materials without permission, notice or compensation. No royalties will be paid at this or any time.
By submitting an entry and Entry Form, each participant (and parent or guardian) assigns all right, title, and interest in and to the entry and Entry Form to FMS Models and RC Driver and warrants that the participant (and parent or guardian) have the authority to assign such right, title, and interest. In the event that any applicable law requires certain formalities to be fulfilled to effectuate such grant of rights, each participant (and parent or guardian) agrees to cooperate with FMS Models and RC Driver to achieve fulfillment of such formalities.
Limitation of Liability: By entering you agree to release and hold harmless FMS Models and RC Driver and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
By submitting an entry and Entry Form, each participant (and parent or guardian) agree to be bound by these Contest Rules. Each participant (and parent or guardian) agrees to release and hold FMS Models and RC Driver, and its employees, agents, representatives, or other affiliated companies harmless from any and all damages, losses, claims and liabilities arising out of participation in the Giveaway or resulting from acceptance or claiming of any prize hereunder. FMS Models and RC Driver reserves the right, in its sole discretion, to terminate, suspend or otherwise cancel the Giveaway at any time, including by reason of force majeure, infection by computer virus, bugs, tampering, unauthorized intervention or technical failure of any sort and to award all prizes in a random drawing from among all eligible entries received prior to the action taken by the Sponsors. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. The total value of the prizes vary, FMS Models and RC Driver is not responsible for any expenses incurred in connection with participation in the Contest.
Failure to execute and return any requested document within twenty-one (21) days of postmark, or return of notification of prize as undeliverable may result in forfeiture of prize and an alternate winner may be selected at the sole discretion of the Sponsor. All reasonable effort will be made to contact the winners.
Disputes: As a condition of participating in this Giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the state of Connecticut having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.
